The present general sales conditions are concluded between the PARLEMENTIA SPOT company , i.e. the "Company" either "Parlementia" or "Parlementia Spot", SARL (LIMITED COMPANY) with a capital of 37.000 €, registered in the register of companies of Paris under the number 513 224 428 the head office of which is located 69, rue Petit - 75019 Paris and every person making a purchase, i.e. " the Buyer ", on the www.parlementia.com site, the property of PARLEMENTIA SPOT.

PARLEMENTIA saves the possibility of modifying at any time the present general sales conditions. Nevertheless, the General sales conditions applicable to the order made by a Buyer on www.parlementia.com are the ones accepted by the Buyer on the day of his order.

Placing an order

The Buyer can place his order to PARLEMENTIA on the www.parlementia.com site.
The order follows several stages.
The Buyer must:
. Select the products he wants to buy by choosing the size, the colour and the quantity,
. identify themselves if they already have an account on the wwww.parlementia.com site, or to create a customer account by filling the form which is then proposed to him
. mention the delivery address as well as any necessary indication to reach this address (digicode, building, floor)
. Choose the method of payment and pay.

The sale will definitively be concluded when PARLEMENTIA will have been credited with the total price of the order. However, PARLEMENTIA reserves the right to cancel any order of a Buyer with whom there would be a problem involving the payment of a previous order.

The validation of the order by the Buyer :

3. means acceptance of the General sales conditions on the day of the order

Confirmation of order

An e-mail is automatically sent to the Buyer to confirm the order.
The Buyer then has to check the exactness of the information supplied to PARLEMENTIA. Any expenses engaged for the sending back of an order which would not have been delivered because of a mistake in the information given by the Buyer will be at his or her expense.

Information on products

PARLEMENTIA will honour the orders while stocks last for the products. In case of lack of availability for one or several products, PARLEMENTIA will inform the Buyer about it as quickly as possible by e-mail.

PARLEMENTIA could not be considered as responsible in case of shortage of stock,  force majeure, or strike.

Photos available on the website present the products as real as they are. However, PARLEMENTIA could not be responsible for differences between – in particular – the visible colors on a computer screen and the real color of the product in the light of day, or in case of mistake in the photograph. In case of dissatisfaction, the Buyer always has the possibility of returning the product for repayment or exchange in the conditions planned in the paragraph "Returns".

Prices

The prices are indicated in Euro inclusive of all taxes and do not take into account the expenses of delivery, nor possible customs charges for the international deliveries.

In case of payment by cheque and to limit the risks of fraudulent use of stolen chequebooks, the delivery address must be identical to the address mentioned on the check.

PARLEMENTIA uses all the necessary means to assure the safety and the confidentiality of the online data. In this purpose, the site uses a secure mode of SSL payment (Secure Socket Layer) which allows the encoding of your banking address and phone number during their transmission on the network. The transaction is made via HSBC and its ATOS person receiving benefits  (ATOS provider), who is the only one to have the bank information given on the site at the time of payment.

PARLEMENTIA reserves the right to suspend or to cancel any order in case of refusal of authorization of credit card payment or Paypal or in case of non-payment or in case of a problem involving the payment of the previous order of the same Buyer.

The Buyer has the original of the invoice in his online account which he can print at any time. The invoice is not joined to the parcel.

Delivery

PARLEMENTIA delivers all over the world. However, for any order abroad, it is better to contact contact@parlementia.com to know the specificities of expenses and conditions of delivery led by this international destination.

Products are delivered to the address indicated by the Buyer on the order form. The Buyer must check the exactness of the information supplied to PARLEMENTIA. Any expenses engaged for the sending back of an order which would not have been delivered because of a mistake in the information given by the Buyer will be at his expense.

In the case of an order paid by cheque, the supplied delivery address must be identical to the address denominated on the cheque.

From confirmation of your payment, we shall post your parcel within 3 working days. Your parcel is then forwarded by COLISSIMO for the variable deadlines according to the destination.

1. Routing by COLISSIMO takes about 2 to 3 days from our deposit at THE POST OFFICE
2. The postal charges are 6,90 € inclusive of tax.
3. The postal charges are free for an order of 100 € or more inclusive of tax by purchase

2. The postal charges are 16 € inclusive of tax.

Any delivery in post office boxes or camping cannot be made.

The delivery deadlines which we indicate are the ones generally noticed. No reimbursement of postal charges will be made in case of delivery for the deadline longer than those indicated.

Parcels are forwarded at the risks and dangers of the Buyer. The Buyer shall systematically check the conformity of the received products, any flaw concerning the delivery (missing or broken product, damaged parcel) will necessarily have to be notified by e-mail in contact@parlementia.com or by mail to the customer service PARLEMENTIA SPOT 69 rue Petit - 75019 Paris the day after the reception at the latest. Over this deadline any complaint will be rejected and the responsibility of PARLEMENTIA will not be involved.

PARLEMENTIA will then ask the Buyer to return them the defective product and will proceed, in case the product is defective because of PARLEMENTIA, to the exchange or to the repayment of the defective product(s), in the choice of the Buyer, in the forwarding of the missing product.

Right of retraction, return and exchange

You have a 10-day deadline from the reception of your parcel to indicate us by e-mail at contact@parlementia.com your will to return one or some of the products delivered as well as the reasons for which you wish to return it or them (unsuitable size…).

In every case, since one or all products are returned to us intact, in Colissimo Suivi at the following address:

we shall pay off to you the completeness of the returned products, with the exception of the expenses of sending and return which remain at your expense.

In case we would have made a mistake in the preparation of your order or if the product is defective because of PARLEMENTIA, we shall pay off to you in addition the expenses of sending and of return.
However, any damage noticed on a returned product due to a flaw in the packaging can cause a partial repayment or an absence of repayment of the product in case of impossibility of resale as it is.

Guarantee

PARLEMENTIA cannot be considered as responsible for non-compliance with the current regulatory and legislative measures in the country of reception, the responsibility of PARLEMENTIA is limited to the value of the involved product. In any event, the Buyer benefits from the legal guarantee of eviction and from the latent defects (Art 1625 and following ones of the Civil code).
On condition that the Buyer gave evidence of the hidden defect, the salesman legally has to repair all the consequences (art 1641 and following ones of the civil code) if the Buyer addresses the courts, he has to do it very quickly” as from the discovery of the hidden defect (art 1648 of the civil code).

A change of legislation, regulations or a decision of justice making one or several clauses of these General Sales Conditions invalid would not affect the validity of all the present General Conditions of Sale.

Duration and application

The present General Sales Conditions apply during all the duration of on-line publishing of products offered by PARLEMENTIA.

Territoriality and applicable law

The sales of products of the company PARLEMENTIA are subjected to the French law. Any dispute concerning the present contract concluded between PARLEMENTIA and the Buyer will be the exclusive competence of the courts of Paris.
